Family to sue Fairbanks police

    Fairbanks, Alaska (KINY) The family of a Juneau man shot and killed by Fairbanks Police on December 24, 2017, plan to file a wrongful death lawsuit.

    The Juneau Empire said an attorney is preparing the lawsuit on behalf of the family of Cody Eyre, 20.  He was shot 12 times and died from a wound to the back of his head according to an independent autopsy report conducted on behalf of the family.

    It will be a federal court litigation with claims that Fairbanks Police and Alaska State Troopers violated Eyre's civil rights.

    Attorney Mark Choate said it has been over eight months since the shooting and very few details have been released.

    All that is known is Eyre possessed a 22 caliber handgun, had been fighting with his girlfriend, and was upset.

    The Office of Special Prosecutions plans to review the department's internal investigation when it is completed.
