Opioid lawsuit can continue

    Juneau, Alaska (KINY) A judge ruled against motions to dismiss the state's lawsuit filed against Purdue Pharma.

    The firm makes the prescription opioid painkiller OxyContin.

    Superior Court Judge Dani Crosby dismissed one claim but invited the state to refile that claim.

    The litigation alleges deceptive marketing practices and laid blame with Purdue for the opioid epidemic.  The motion to dismiss argued that the state is trying to hold the company responsible while disregarding other facts that led to the epidemic.  Those include a doctor's judgement and decision to write the prescription and the patients decision on how much and how long to use the drug.
